The Nansemond Indian Nation has filed a federal lawsuit against the state of Virginia, accusing it of undermining the tribe’s sovereign rights and violating federal law by withholding $1.7 million in Medicaid claims. The tribe operates Fishing Point Healthcare, a clinic serving both Native and non-Native patients. The lawsuit alleges that Virginia is attempting to shift blame for its financial mistakes and is pressuring the clinic to restructure in a way that would reduce its competition with private providers. The state has refused to pay Medicaid claims for certain services since October 2023, freezing a total of 7,650 claims by March 31. This freeze is said to be a financial strain that threatens the clinic’s operations.

Fishing Point Healthcare, founded in 2023 after the Nansemond tribe gained federal recognition, provides healthcare to both tribal members and the broader community. Despite the challenges, the tribe continues to provide care and plans to expand its services. The tribe claims that the state’s actions aim to limit the clinic’s role in the healthcare system, which could harm the tribe’s ability to sustain its operations.
